ORP Update - May 26, 2004

Lawsuit Status – AOF received a proposed settlement agreement from OUS on 5-21. It was deficient in several areas and our counsel, Tom Doyle, is in the process of preparing a counter-proposal. Two of the areas of concern that we have relate to the process for how OUS will compute contribution rates in the future if more PERS debt bonds are sold and assuring that the settlement clearly and completely applies to all ORP members, not just the named plaintiffs.

Statutory Amendments to ORP Statute – OUS continues to push for decoupling the ORP contribution rate from the PERS contribution rate. At a meeting on May 24, 2004, which was also attended by representatives from IFS, AAUP and AFT, all groups expressed to OUS officials that we would not support uncoupling the rates. We did agree to look at two other changes they suggested that relate to preventing a recurrence of the November 2003 fiasco and to address specific ORP issue concerning adjunct and part-time faculty. These proposals are being reviewed by AOF’s legal counsel.
